Will he have to do a lot of time for having sex with a minor?
My nephew was recently charged with having intercourse with a minor. He was at a party and both participants were intoxicated. The young lady told my nephew that she was both willing and of age. My nephew is only 20, has a clean record, works full time, and attends college. From what you say, and this is without all the facts, he will not do serious time. This always depends on what you consider serious time. This is a case that is heavily fact driven and your nephew needs a attorney. This is mandatory! Have him contact me for a free consultation.

YES! You must hire an Attorney on this one! Sex with a Minor charges cannot be taken lightly! Even if he gets Jail, not prison., it could be for one year! However, worse yet, is the sex registration for life he may face. You could beat the charge if you could show: 1. The Defendant believed she was eighteen; AND, 2. a Reasonable Person (THE JURY) would believe she was eighteen. You didn't mention the girl's actual age; but know this: the possible sentence increases as the child hits certain ages: (i.e., under 16, under 14, etc.) Also relevant is the Difference in Age between the Defendant and the Child-Victim) (i.e., 2 years difference, 5 years, 10 years, etc.) What make no difference at all (i.e., legally irrelevant)is Her, Consent because she cannot consent when under the age of 18. The alcohol issue may mitigate (lessen) the impact but would be little help in defense- actually it could add to the charges (contributing to the delinquency of a Minor) BOTTOM LINE: HIRE AN ATTORNEY ASAP!
