Question

What should I do after being charged with DUI and collision?

I got my first DUI earlier this week. I had been drinking at the house of a friend and was on my way back home. It was a very short drive. However, I got into a very minor collision with another vehicle. Neither of us were speeding and there were no injuries. Now the people in the other vehicle claim that they are going to bring a suit against me. I am scared of financial problems because of my low insurance limits. Do I have any chance of fighting and beating this?

You cannot fight this one- you will lose. They will get their money from you either through restitution (via the criminal DUI case), or Civil (through a lawsuit), or simply through a claim to your insurance company. You need a lawyer on this one. A lawyer may be able to work out a settlement and get the financial part of your problem to go away pursuant to a civil compromise provided by the Penal Code. Then you would be able to simply Plea to the First Time DUI with the normal first time probationary terms and avoid jail time. You need to hire an Attorney on this one. Even if you have already been sued, a competent Attorney can resolve.

This is a very serious situation and you would benefit by hiring an attorney to defend you as soon as possible. You can contact my office for a consult if you live in the area of my practice.
