Question
What kind of theft charges am I facing?
I falsified paperwork at the store where I worked so that my friend could take about $500 dollars worth of merchandise from the store. We were both caught red-handed while trying to get him the merchandise and we immediately returned everything. I have not been arrested and I was not even fired at first. They just told me that they are going to let me go and that they are considering charges today. What am I facing?LawQA.com Answer Library

Depending on what you admitted to, you may be charged with embezzlement or grand theft by fraud. Since the value of the items is over $400, you may be facing felony charges, meaning that the maximum punishment for a conviction is 3 years state prison. If this is your first arrest, it is unlikely that you will be facing prison as a consequence. I am assuming the following: no firearms involved or falsified paperwork signed under the penalty of perjury.

You are facing possible grand theft and embezzlement charges. You should really consider hiring a criminal attorney BEFORE you make any statement to the police. Feel free to contact me for a consultation.
