Question

Is it easy to defend a .08 blood alcohol content?

I have never been in trouble with the law for anything. I am a bartender and work late nights. I was charged with a DUI and they say that I had a .08 blood alcohol content. I was not even drunk at all! Since it is pretty low for a DUI, will it be easy to defend against this? Thank you.

A 0.08 is defenseable. However, like all criminal cases it is fact driven. I will need to sit down with you to answer your question. Contact me for a free consultation.

I can do more for a person with a DUI with a .08 blood alcohol concentration (BAC) than for someone with a higher BAC level. You should consider hiring a criminal lawyer experienced in DUI and DMV matters. I'd be happy to discuss this matter with you. By the way, you have only 10 days from the date of the arrest to take some action with the DMV or you lose valuable rights. Time is of the essence. Don't wait. Good luck.
