Can I get my felony expunged?

I was charged with a felony bringing contraband into a penal institution. Can I have this expunged?

You must first successfully complete the terms of your probation. After that, you can have your felony reduced to a misdemeanor and then have that misdemeanor expunged.

Yes you can get it expunged, you may also be able to get it reduced to a misdemeanor.

Yes, but you must first finish parole or probation. Then you need to hire an attorney to file a 17b motion to reduce the felony to a misdemeanor. Then, if granted, the attorney can petition the court to expunge the misdemeanor.

It will depend. If you served time in state prison than no. I would contact a local attorney in your area that handles criminal law and give them all the facts to determine if you are eligible.

If you did not go to prison then the answer is yes, but you will have to review Penal Code Section 1203.4 to see if you qualify under the facts of your case.

If this is a federal felony, no. Expungement is not available on federal crimes. If it is a CA state felony, many convictions can be 'expunged' from criminal records by proper application and Petition to the court, but only if there was no felony prison time sentenced, and if all terms of sentencing and at least one year of probation are completed, and if there are no new charges pending.

It depends. You can get a felony conviction expunged if you did not serve any time in a state prison for that offense.
