Can I get a minor in possession MIP infraction dismissed?

I was visiting my friends new off campus apartment and I was carrying an unopened beer. I am 18 years old. I live in a different county. Is there any way to dismiss this infraction without a lawyer?

You will probably need a lawyer. Remember that MIP, even as an infraction, can result in a 1 year suspension of your license. An attorney can best negotiate with the judge so that you can earn a dismissal. Sometimes this involves you taking an alcohol class.

The problem you face is that if you're convicted, you will lose your driver's license for a year, so it's not something you want to mess around with. A local criminal defense attorney that routinely practices in the county where your case is will probably be able to work something out and avoid a conviction in this case.

You may be offered attendance at an alcohol class in exchange for a dismissal.

Not really. If you retain a lawyer the lawyer can appear in court for you and you can return home. You must personally appear in court at your court date if you do not retain a lawyer. You are not entitled to a court appointed lawyer since this is an infraction However, you can lose your driving privilege for one year so you do not want to plead guilty to this infraction.
