Question
Can I get arrested for driving with a suspended license?
I had a warrant due to missing my mad class for the second time on a first time DUI case. When I got pulled over for that DUI I also was driving in a suspended license and sited for the 3rd one. I got my 3rd dropped and was put on informal probation plus DUI classes and fines. I then recently was pulled over and received a ticket for driving on suspended do and no proof of insurance. A few months Later I was with a friend she was driving and we both had warrants got pulled over and I had a tiny amount of meth (residue plus a pipe they say with residue and they took me to jail charged me with a felony because I also had a warrant. I have my arrangement the 6th of June. What's going to happen I live in California. They searched my bag and went through my phone even took the phone and searched my friend's car. The cop even told me that he could let me out of jail if I give him names of my friends.LawQA.com Answer Library

The direct and simple answer is yes. When you are cited for a DUI there is a 30 day hard suspension of your driving privileges (there are a few ways around this). After this period a restricted license may be available for driving to and from work or school. Another issue is the DMV hearing that you also have to go through. You have 10 days from the day of being given a citation to request the DMV hearing. In regards to what will happen to you is it depends. There are a lot of factors that can help to mitigate in your favor. There are a lot of questions that the facts you present raise. Without having the answers to those questions it is difficult to advise of the punishment you may be facing. I would suggest that you speak to an attorney immediately. The charges against you are quite serious and the fact that you have priors makes the situation much more difficult.

Yes, you can get arrested for driving on a suspended license. If you do decide to make a deal with the police that you will give them the names of fellow drug dealers in exchange for a dismissal, you need to get this in writing. The District Attorney is the only government entity that has the authority to charge people for crimes. The DA must be involved if the police are going to offer you a deal.

On the warrant for the classes you will have a probation violation hearing. You will be found in violation. The court can then reinstate your probation from that date on (back to three years), or send you to jail for the amount of time that was suspended on the case. Normally, a driving on a suspended license and no proof of insurance will be reduced to driving without a license if you can show the Judge a valid license and proof of insurance at your court date. If you cannot then you will be looking at up to one year in county jail and fines. The meth charge could be a misdemeanor or a felony depending on the DA and the amount. You will not be charged with possession for sale due to the fact that you did not have a large amount or scales etc. Because you were on probation and so way your friend you both could be searched without probable cause and so could her car. This also includes your phone. Without an attorney you are looking at time in county jail. An attorney may get you a plea without jail.

Sounds like you've got a lot going on and many problems that need to be resolved. You've laid out several reasons why a judge might put you in jail again. None of this is going to stop until you get your license back. You need to contact the DMV (a lawyer can't do this for you, you have to do it) and ask them exactly what they required of you to get your license back. If at any point you could tell the court that you've gotten your license back it would go a long way towards things being forgiven. Good luck.

Yes, the police can arrest you or cite you for driving on a suspended license. The police can always arrest you if you have a warrant for your arrest. Whether the searches of your bag was lawful will depend upon many factors.

You need an attorney to deal with this. You are facing jail time. Do not speak with anyone other than your attorney.
