Pregnancy or no pregnancy, charges can be filed. The pregnancy is just another form of proof of the crime. A 17 year old, providing the individual is not emancipated from the parents, cannot legally provide consent to any sexual act. This would be a serious charge, and one which should be addressed by an attorney. Seek legal counsel.
